The Milan prosecutor's office is appealing to the Court of Appeal against the judge’s order that rejected Glovo’s obligation to employ riders. The Milan Prosecutor’s Office continues to request that all Foodinho-Glovo riders be hired as employees, through the judicial administrator. It still argues that with the new plan proposed in recent months, the Spanish giant's food delivery company is continuing to operate in an “illegal situation” regarding the wages paid to delivery cyclists who work for the platform because, despite compensation increases, workers are still not being paid "around 30% of their activity." The investigating magistrate Paolo Storari, head of the carabinieri’s Labor Protection Unit that placed Foodinho-Glovo under judicial control in February for worker exploitation, has filed the final submission with the Court of Appeal against Judge Roberto Crepaldi's order, which two days ago rejected the Prosecutor’s request. This request asked the judge to require the delivery company to apply employment contracts for delivery cyclists and therefore have them hired. According to the investigating judge, the assessment of how to classify the riders – whether as employees or self-employed – is up to the relationships between companies and unions in negotiations on collective bargaining and the labor judges who can verify individual positions in lawsuits. A “generalized qualification” of all as employees, "regardless of the frequency" of their activity and the fact that they have one or more clients, would have a “economic-organizational impact” not only on the company but also on the workers themselves, “required for a much stricter performance” in terms of “hours and single client assignments." The Prosecutor's thesis is decidedly different, according to which riders should also be classified as "employees," not self-employed, based on a recent decree by Prime Minister Meloni, because when there are “powers of direction and control, there is a presumption of subordination, unless proven otherwise.” Now the Court of Appeal must schedule a hearing for discussion. Following Ilva, 24-hour strike and road blockades: suppliers' workers protest against the risk of 2,500 layoffs due to the closure of the hot area. The workers of the Ilva spinoff in Taranto have declared the first 24 hours of strike from 9:00 am today until 7:00 am tomorrow. The decision came after the meeting held today by the secretaries of the FIM, FIOM, UILM and USB unions, jointly with other categories, in front of the porter service of the plant. “Let it be clear, we will not stop unless there are solutions and extraordinary measures for all workers,” the statement signed by the worker organizations announced. The workers have occupied the provincial road to Statte as a sign of protest but a traffic block is also expected on the state highway in the direction of Bari. The mobilization reflects strong fears about job security after the Court of Appeal in Milan’s decision to order the closure of the hot zone, the heart of the factory, by October 25th. The risk is collective dismissal of approximately 2,500 workers, linked to the stop imposed by the Milan magistrates. A new table between the government and unions is scheduled for tomorrow at Palazzo Chigi regarding the former Ilva. However, until yesterday, no formal invitation had yet arrived either to the trade union organizations or to the commissioners of the extraordinary administrations of Ilva and Acciaierie d’Italia. Even today, the CGIL confirms the lack of an invitation: “We asked the government to sit down at a table with us, we did, but there has been no response regarding the workers. The invitation for tomorrow at Palazzo Chigi has not yet arrived. The closure of the hot zone is the responsibility of all governments: the decree by the Court of Appeal in Milan has filled a void in politics,” said Francesco Brigati, general secretary of FIOM CGIL Taranto, during the worker’s stand. “The time has run out,” the unions reiterated, demanding job guarantees, income protection and an industrial plan for Taranto. He killed the thief who was robbing his store: sentenced to 1 year and 8 months for manslaughter. But he won’t go to prison. He realized that someone was robbing his tobacco shop in the night and fired from his balcony, killing the thief. For the Court of Appeal in Turin, the manslaughter committed on June 7, 2019 by Franco Iachi Bonvin, who was finally sentenced to one year and eight months without imprisonment, was culpable. The sentence, partially revising the judgment pronounced on May 30, 2024 by the court in Ivrea which had convicted him in first instance of five years imprisonment, recognized mitigating circumstances, with a reduction for the choice of procedure and with the benefit of conditional suspension of the sentence. The defense had waived an appeal to the Supreme Court, closing the judicial process. After the deadlines passed, the ruling from the Cassation Court arrived. As reported in the judgment of the judges at the Cassation Court, around 2:30 a.m., while Marcellino Franco Iachi Bonvin “was sleeping on the second floor of the property where he lived, in Pavone Canavese, he heard the alarm siren of the Fast-Furius intrusion system (owned by him but managed by others) on the ground floor of the same building and, leaning out from the balcony, had noticed three individuals with their faces covered who were loading electronic money changers stolen from the bar (which turned out to contain an amount of €3,000) onto a van (later found stolen). The tobacconist fired several times with a .357 revolver legally held, hitting and killing 24-year-old Ion Stavila with one of the bullets. According to the judges, the situation was comparable “to the hypothetical case of self-defense”: Marcellino Franco Iachi Bonvin, by firing the shot that killed Ion Stavila, “had inadvertently overstepped the limits of self-defense.” For this reason, the appellate judges modified the charge from voluntary manslaughter to manslaughter.
