Even at this point, SCOTUS's test for "is it racist?" isn't ... "is it racist?" It's just "would it make me feel bad to say that this policy or action is racist because I'm cool w said policy or action but I don't want to have to publicly admit that I like racism too?"

One thing an expanded SCOTUS absolutely has to do is move away from this individualized "what is in his heart?" definition of "racist" to something much more systemic and structural. It's going to make A LOT of (white) conservatives VERY angry. They will yell "ARE YOU CALLING ME RACIST?" Me: Man Nodding with 'YES' Caption
